FiberShare by BitPrairie: Terms of Service
DRAFT - not legal advice, have a California attorney review. Prepared for BitPrairie LLC on October 11, 2026. Fill in every [BRACKETED] item before publishing.

1. Who we are
These Terms are an agreement between you and BitPrairie LLC, a California limited liability company ("BitPrairie," "we"). BitPrairie operates FiberShare, a ranch sponsorship program, live herd map, and fiber shop at fibershare.app, fibershare.dev, fibershare.us, and bitprairie.com/fibershare, plus the FiberShare mobile app (the "Service"). The ranch is [RANCH NAME / Linden pasture], [CITY/COUNTY], California. Contact: hello@bitprairie.com, legal@bitprairie.com [CREATE], [MAILING ADDRESS].
By creating an account, sponsoring, buying, or using the Service, you agree to these Terms, the Privacy Policy, and the Sponsorship, Shop, and Refunds Policy.
2. Eligibility
You must be 18 or older and able to form a binding contract. Students using the HardKnox herd lesson use hardknox.org, not FiberShare accounts.
3. Sponsorship is not an investment
A sponsorship is a payment to support the care of fiber animals and the ranch program. You do not buy, and we do not offer, any equity, membership interest, ownership of an animal, land, or fiber crop, share of revenue or profit, interest, loan, or any expectation of profit from our efforts. Thank-you gifts are optional, have no cash value, and may not ship. Do not sponsor if you are looking for a financial return. [ATTORNEY: replace the old page's statement that the program "is not regulated as a security"; the company cannot decide that itself. Keep all marketing free of return, yield, appreciation, or resale language. Keep this program completely separate from any investor raise for the pellet machine or land.]
4. Supporter badges
A supporter badge is a thank-you receipt. It is not a security, ownership interest, or anything sold by FiberShare. We do not run, list, price, or match a marketplace for badges. [CONFIRM whether badges are still minted on-chain as compressed NFTs. If yes: say they are non-transferable where technically possible, that any off-site transfer is final and at the user's own risk, and that a badge gives no right to perks after transfer. If minting has stopped, delete this paragraph's NFT references.]
5. Herd map and collar data
The map shows virtual positions on a grid relative to the herd and the time each collar last reported. It does not show GPS coordinates or the ranch's street location, and it may be delayed, wrong, or offline. Do not visit the ranch without a written invitation. Trespassing, approaching, or disturbing animals is prohibited.
6. Payments
Payments are processed by Stripe (card, Apple Pay, Google Pay), PayPal, or USDC. Current PayPal sponsorships charge once for the month or year you choose and do not renew. A Stripe sponsorship subscription, if one is offered, renews automatically until you cancel. USDC pays one period and does not renew. Cancel a renewing plan online at Cancel my plan without a wallet. Stripe: billing stops at the end of the current period. We set cancel at period end, and access continues until that period ends. PayPal: billing stops immediately. PayPal's cancel API ends the subscription now, and FiberShare keeps access until the end of the period you already paid for. See the Sponsorship, Shop, and Refunds Policy for renewal, cancellation, and refund terms. You are responsible for your own crypto wallet and keys. USDC payments sent to the wrong address or on the wrong network may be unrecoverable.
7. Fiber shop and approved farms
The official BitPrairie store sells ranch fiber. Approved outside farms may list their own products in the directory. Each outside farm is the seller of its products and is responsible for their description, quality, shipping, taxes, and returns. BitPrairie is not the seller of outside-farm goods, except where we say otherwise at checkout. [ATTORNEY: decide whether BitPrairie collects payment for farms; if yes, a marketplace seller agreement and California marketplace-facilitator sales-tax registration are needed.]
8. Acceptable use
You agree not to: misrepresent a sponsorship or badge as an investment or sell it as one; harass staff or other users; scrape the map or try to derive the animals' physical location; attack or probe the Service, collars, or LoRa systems; use stolen payment methods; or use the Service for money laundering or any illegal purpose.
9. Animal welfare
Animal care decisions belong only to the ranch and its veterinarian. Sponsorship does not give you a say in care, breeding, sale, shearing, or end-of-life decisions. Animals can get sick or die; we will tell sponsors of their sponsored animal's death and offer to move the sponsorship to another animal or cancel it.
10. Content and intellectual property
The Service, photos, video, map, names, and the FiberShare and BitPrairie names and logos belong to BitPrairie LLC or its licensors. You may view them for personal, non-commercial use.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, BITPRAIRIE LLC DISCLAIMS ALL IMPLIED WARRANTIES. Fiber goods sold by BitPrairie carry any warranty stated on the product page, and any warranty that cannot be disclaimed under California law.
12. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW: (a) BITPRAIRIE LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100. Nothing here limits liability that cannot be limited by law, including under California Civil Code section 1668, or your rights to dispute a charge with your card issuer.
13. Disputes
Informal first: email legal@bitprairie.com and give us 30 days to resolve it.
[ATTORNEY: choose ONE of the following and delete the other.]
- Option A, courts: any claim must be brought in the state or federal courts in [COUNTY] County, California, or in small claims court.
- Option B, arbitration: binding individual arbitration under [JAMS/AAA] consumer rules, in [COUNTY] County or by video, with a small-claims carve-out, a 30-day opt-out, and a public-injunctive-relief carve-out (McGill v. Citibank). Class-action waiver to the extent allowed by law.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
15. Changes
We will post changes and, for material changes, email account holders at least [15] days before they take effect. Changes do not apply retroactively to disputes already raised. Price changes to a renewing sponsorship follow the refunds policy.
16. General
If any part is unenforceable, the rest stays in effect. You may not assign these Terms. These Terms and the linked policies are the entire agreement.
California users: Under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
